Lien Enforcement Program

MAXIMIZE YOUR REIMBURSEMENTS BY IMPLEMENTING A LIEN ENFORCEMENT PROGRAM

Any accounts coming through admissions with a trauma or accident code can be placed with our firm and covered under the Texas Hospital Lien Statute. In 2003 the legislature revised the Texas Hospital Lien Statute to also include emergency medical services providers that provide services in counties with a population of 575,000 or less. Now ambulatory services can also file a lien to recover funds for services rendered when an individual is injured in a motor vehicle accident. Allowing our law firm to prepare your liens ensures that your claims will be monitored and your rights will be protected.

Timely filing and recording statutory liens reinforces the right to recover funds for services rendered to patients involved in accidents, in which negligence can be attributed to another individual. Filing and recording liens provides notice to all parties involved, making them personally liable if they fail to honor the lien when the claim settles. Unfortunately, even though liens are recorded, a significant number of insurance companies and attorneys fail to satisfy these liens when a case is settled because most medical providers don’t have the time or resources to fight for their rights. Our law firm will help to ensure your rights and your claims are protected and included in the settlement.

After filing the lien with the county clerk, we will follow-up and negotiate with the various parties involved until a settlement has been reached or a judgment has been granted. Finally, once the claim has been resolved and the hospital has received payment, we will prepare and file a release of lien with the clerk.

The key benefits of placing these types of accounts with us:

  1. Legal intervention increases your chances of recovering reimbursements.
  2. Legal intervention reduces the likelihood of a collectible account turning into a bad debt account.
  3. Legal intervention minimizes the time your staff spends working these types of accounts.
  4. We continuously follow-up with the attorneys and insurance adjustors to ensure the medical service provider is included in the settlement.

Call us to discuss how we can implement a lien enforcement program and help your facility fight for their rights and increase their reimbursements.
