UTILIZING STATUTORY LANGUAGE AND CASE LAW VERDICTS WHEN WRITING INSURANCE APPEALS MAXIMIZES YOUR REIMBURSEMENTS:

Within the last 6 years Congress has passed many new prompt pay laws that greatly affect the likelihood of whether or not your claims will be processed for payment or denied. House Bill 610, passed in 1999, was originally designed to expedite HMO and insurance company payment of “clean claims” submitted by physicians and providers.  Because providers continued to have concerns that claims were not being paid in a timely manner, Senate Bill 418, which the legislature passed in 2003, made changes to the law to make claims filing and prompt payment processes  more efficient.  Understanding the Senate Bill 418 (a.k.a Texas Prompt Pay Statute) and its key provisions increases the likelihood of getting your claim paid the first time. Once you place a claim with my firm, I will ensure that the insurance company adheres to these rules and regulations when reviewing your claim for payment.

Unfortunately, the prompt payment language does not regulate self-funded (ERISA) benefit plans. ERISA is a federal statute that generally preempts state prompt pay laws. However, despite these preemptions, my firm has successfully persuaded self-funded plans to reconsider their original denial and reprocess these types of claims for payment too.  I work very hard to ensure that you receive reimbursement from my insurance appeals.

Allowing an experienced and knowledgeable health law attorney to handle your denied claims not only increases the likelihood of your appeals being reconsidered, but also increases the likelihood that your claims will be paid properly and promptly. This is what I can do for you:

1. Increase Reimbursements: I will write a persuasive appeal that includes applicable language from the Texas Insurance Code and pertinent case law to increase the chances that your claim will be reconsidered promptly and accurately.

2. Increase Revenue: Working as a solo practitioner means that there are no over head expenses passed on to you, which means you pay a lower contingency fee.  I will personally write the appeal and do all of the follow-up necessary to get your claim reconsidered for payment.

3. Experience and Affordability: With over 10 years experience in health care reimbursement law, The Law Office of Kristin K. Kline is the more experienced and affordable choice when it comes to health care.

Call today to discuss how I can help you recover payment for your denied health care claims.
